DOE Proposes New Rule on Critical Electric Infrastructure Information

On October 29, the U.S. Department of Energy (DOE) published a proposed rule for public comment to establish procedures for the designation of critical electric infrastructure information (CEII) under the Fixing America's Surface Transportation Act or FAST Act (Public Law 114-94). Under the proposed rule, DOE would establish a set of procedures by which the Secretary of Energy would designate, protect, and share CEII under the new section 215A of the Federal Power Act, according to criteria the Federal Energy Regulatory Commission established and codified in 18 CFR 388.113(c).
